EAT HAPPY Advent Calendar Prize Draw / Terms and Conditions of Participation

ORGANISER

The organiser of the prize draw “Eat Happy Advent Calendar 2023” (“Prize Draw”) is EatHappy ToGo GmbH, Hohenzollernring 31-35, 50672 Cologne (“Eat Happy”).

PRIZES

The main prize is a trip to Japan “Japan Kompakt” for 2 people from Gebeco worth approx. 6.000 € (fixed travel period: 04.10. – 13.10.2024). In addition, there are 23 daily prizes: 2 x Eat Happy shopping voucher worth 100€ each; 1 x teppanyaki grill; 1x SMEG food processor; 1x Reishunger rice cooker; 1x Woklette; 1x Japanese knife including cutting board from Zwilling; 1x wok including spatula from Zwilling; 1x kitchen accessories package from Zwilling; 1x surprise package from EAT HAPPY; 1x surprise package sushi kit; 1x Miomente Asia Box; 2x sushi tableware set from Moritz&Moritz; 1x Asia spice box from Just Spices; 1x gift box from Rituals; 1x gas grill from Burnhard, 1x GetVoila voucher worth 100€; 1x gift box “Wellnesshotels” from mydays; 1x matcha starter set; 1x yoga mat from Lululemon; 1x e-scooter from Xiaomi; 1x trip to Düsseldorf for the Japan Day (250 € voucher me and all Hotel + 300€ spending money)

PARTICIPATION IN THE PRIZE DRAW

a) Participation in the prize draw is subject exclusively to these Terms and Conditions of Participation. By taking part in the prize draw, the participant accepts these Terms and Conditions of Participation.

b) Any natural person whose permanent residence and delivery address are in Germany is entitled to participate. Persons who have not yet reached the age of 18 are excluded from participation. Legal representatives and employees of EatHappy GmbH as well as of FCF Holding GmbH and all associated subsidiaries, together with their relatives and relatives by marriage of the 1st and 2nd degree, are not entitled to participate. Persons not entitled to participate acquire no claim to a prize even if a prize is allocated to them.

c) After purchasing a promotional product priced from EUR 2,99 to EUR 69,99, a person may take part in the prize draw by clicking the “Jetzt teilnehmen” (Take part now) button online at “http://eathappy.de/advent”, clicking on one of the 23 doors of the virtual advent calendar displayed there and registering for participation in the prize draw. Registration is carried out by entering the individual promotional code located on the inside of the lid of the promotional box, the form of address as well as the participant’s first and last name and their e-mail address in the respective input fields provided, confirming the Terms and Conditions of Participation as well as consenting to the data processing and clicking the “Jetzt teilnehmen” (Take part now) button. By signing up for the EAT HAPPY newsletter, the participant receives an extra code as a gift.

d) Until 30 November 2023, the participant has the option of entering their promotional code in any one of the 23 doors of the advent calendar. From 30 November 2023, the corresponding door of the advent calendar for the following day will be closed each day at 23:59; an entry in the closed door is no longer possible and the participant can only enter the code in the input fields of the advent calendar that are still open.

e) With each promotional code the participant can take part in the prize draw once. Multiple participation in the prize draw with several promotional codes is permitted. Each participant may only take part in their own name. Furthermore, prizes cannot be exchanged for other prizes.

f) Participation in the prize draw is only possible between 14 November 2023 and 22 December 2023, 23:59.

DETERMINATION OF THE WINNERS

From 01 December 2023, the daily prize allocated to the respective input field will be determined each day by an electronic random generator from among the participants who entered their promotional code in the input field of the advent calendar closed on that day. From among all promotional codes entered during the promotional period, the main prize of 24 December 2023 will be drawn by an electronic random generator after the end of the prize draw.

PRIZE NOTIFICATION AND PRIZE DISTRIBUTION

a) The participant will be notified of their prize by an automated e-mail.

b) For the further processing of the prize draw, the winner is obliged to notify Eat Happy by e-mail of the data required for delivery, in this case their address (“delivery address”), within 7 days of receipt of the prize notification. By transmitting this data, the winner automatically declares their willingness to accept the prize.

c) In this case, the prize will be dispatched by post to the address provided by the winner. If this deadline is not met, the prize lapses without replacement. The same applies if the prize cannot be delivered to the delivery address within six weeks.

d) The winners of the “Eat Happy shopping vouchers” must comply with the validity periods and deadlines of the respective third party. If the voucher is not used, the credit generally expires after 3 years.

e) The winner of the main prize, a trip to Japan worth 6.000€, will receive an e-mail after the draw informing them of the prize. The winner is obliged to notify Eat Happy by e-mail within 7 days of receipt of the notification whether they accept the prize. In addition, the winner must provide Eat Happy with a telephone number in the e-mail so that the necessary organisational arrangements can be made.

f) Eat Happy does not pay out the cash equivalent of a prize. In the event of a win, the participant declares that any costs and other services that are not advertised as a prize or as included in the prize will be borne by them (in particular telecommunication charges). Claims for compensation by the initially determined winner against EatHappy are excluded.

FURTHER REQUIREMENTS FOR CLAIMING THE MAIN PRIZE

Claiming the main prize by the winner is additionally subject to the following:

a) The winner of the main prize undertakes to accept the prize within 7 days of the notification.

b) The winner further agrees that they may be named by name in the relevant advertising or editorial coverage.

MISCELLANEOUS

a) Eat Happy is entitled, in the event of force majeure, a change in the legal situation or in case law, on the basis of an official or judicial prohibition, for technical reasons or due to external circumstances beyond Eat Happy’s control, to exchange the announced prize and replace it with another prize, to change the course of the game or the Terms and Conditions of Participation, or to cancel or discontinue the prize draw. In these cases, participants and any winners already determined have no claims against Eat Happy.

b) If a participant breaches the Terms and Conditions of Participation, Eat Happy is entitled at any time to exclude them from participation without prior notice.

c) Recourse to the courts is excluded. Should individual provisions of the Terms and Conditions of Participation be invalid, the remaining provisions remain valid.

d) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

DATA PROTECTION

a) Participation in and running of the prize draw

In order to take part in the prize draw, the participant must provide their form of address, their first and last name and their e-mail address. The e-mail address as well as the first and last name serve for registration and for displaying the promotional codes entered by the user so far, as well as for participation in the final draw for the main prize.

In the event of a win, for the purpose of claiming it and for the delivery of prizes in kind, the participant must additionally provide a domestic delivery address (street, house number, postcode and town) for further participation in the prize draw. In the case of the main prize, a telephone number must additionally be transmitted for necessary organisational arrangements.

The personal data entered in the course of the prize draw will – unless the participant has additionally signed up for the Eat Happy newsletter – be processed exclusively for the purpose of running the prize draw. This includes disclosure to external companies / service providers for the purpose of claiming the main prize as well as dispatching the other prizes. In connection with claiming the main prize, Eat Happy or the organiser of the trip will make contact in order to coordinate the processing of the prize claim. In connection with the dispatch of prizes in kind, the freight forwarding company may make contact in order to arrange the delivery date.

The data will be deleted after the end and completion of the prize draw, insofar as no statutory retention obligations exist.

The data processing for the running of the prize draw takes place on the basis of the participant’s consent pursuant to Art. 6 (1) sentence 1 lit. a) GDPR and on the basis of Art. 6 (1) sentence 1 lit. b) for the running of the prize draw. In the case of statutory retention obligations, processing takes place on the basis of Art. 6 (1) sentence 1 lit. c) GDPR.

The participant has the right to withdraw consent once given to the processing of data at any time with effect for the future. The participant should address the withdrawal to the controller named below. The withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of the consent up until the withdrawal. With the withdrawal, the participant simultaneously declares that they are no longer taking part in the prize draw.
